Companheiros,
Na ação ajuizada pelo nosso Sindicato contra a Caixa Econômica Federal em que pretende a declaração do direito dos empregados das categorias representadas em ter seus depósitos vinculados ao FGTS corrigidos monetariamente por índice que supra a inflação apurada, bem como o pagamento do valor correspondente às diferenças de FGTS em razão da aplicação da correção monetária pelo INPC (ou IPCA) nos meses em que a TR foi “zero” ou inferior ao índice aplicado, nas parcelas vencidas e vincendas.
E que pede seja declarado o direito dos empregados das categorias representadas pelo em ter seus depósitos vinculados ao FGTS corrigidos monetariamente por índice que supra a inflação apurada, bem como o pagamento do valor correspondente às diferenças de FGTS em razão da aplicação da correção monetária pelo INPC (ou IPCA) nos meses em que a TR foi “zero” ou inferior ao índice aplicado, nas parcelas e vincendas, a partir do ano de 1999 até o momento atual, ou, subsidiariamente, entre os anos de
1999 e 2013.
Em razão de decisão monocrática proferida nos autos da ADI 5090, o Min. Roberto Barroso, determinou a suspensão de todos os feitos que versem sobre a matéria, até julgamento do mérito pelo Supremo Tribunal Federal (ADI 5090, Rel. Min. Roberto Barroso, DJE nº 196, divulgado em 09/09/2019 DJ Nr.196 do dia 10/09/2019.
