Quem foi demitido ou pediu demissão depois da data-base da categoria (data anual de revisão do acordo coletivo), mas antes da concessão do aumento, tem direito a ter sua rescisão recalculada com base no salário reajustado.
O trabalhador deve estar atento para o período de aviso prévio. Assim, se o empregador comunicou a dispensa a 30 dias ou menos da data-base, o término efetivo do contrato será posterior a ela, o que dá ao funcionário o direito de ter sua rescisão calculada.
Quem tem mais de um ano de casa deve acrescentar ao período de aviso prévio três dias para cada ano trabalhado, respeitando o limite de 90 dias.
Quem se demite depois da data-base, mas antes do reajuste, tem direito à rescisão complementar independentemente de ter cumprido o aviso prévio ou não.
Se o funcionário não trabalhou o período, porém, o desconto de 30 dias de salário aplicado nesses casos também pode ser corrigido pela empresa, implicando uma redução maior da verba.
